I am sure it must be frightening to be an individual sued for libel, nevertheless, Mr Jones is worrying unnecessarily about the subjectivity of the meaning of spitefulness if he has demonstrably written the truth. Spitefulness becomes an issue only if he has not written the truth or has been reckless about whether or not it is the truth. I refer to the last sentence of paragraph 76 of the judgement,"A reviewer is entitled to be spiteful, so long as she is honest, but if she is spiteful, the court may more readily conclude that misstatements of fact are not honest, since spite or ill will is a motive for dishonesty."

I don't agree with either of you (blog or video). Babies are much smarter than people think they are. However they are so smart that even if they did think a magazine was a broken i-Pad they would soon learn it was a magazine. This little girl will not FOREVER be ruined for all print. It's mostly down to the parents and if this parent is filming her playing with an i-Pad instead of interacting with the baby then maybe this baby is stupid.

Where has the parent gone that communicates with their kids instead of letting electronics babysit them.
Become a real parent to have a real child.

Babies are idiots, but they are quick learning idiots. What they are doing is trying things out and seeing what happens when they do things. In a way, both stances are correct.

Babies will learn that by touching things, they can make things happen, but will not necessarily have understood the differences between an iPad and a magazine. However, this will come with time, and yes, they will learn the difference.

Whether they classify a magazine as an iPad that doesn't work, or an iPad as a magazine that you don't have to turn makes no real issue - what is important is that in time babies, as with all people, will be able to tell the difference between an iPad and a magazine. It's how we learn. That's exactly the same way that people learn the difference between anything really.
